Terms of Use

1. The App (what it does)

Orbit is a relationship tracker that helps you organize people you want to stay in touch with, set contact frequencies, track contact history, and receive reminders and special-date notifications.

Orbit is designed as a local-first app: your Orbit data is stored on your device unless you choose to export/share it.

2. Eligibility

You must be able to form a binding contract in your jurisdiction to use the App. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Your responsibilities

You agree that you will:

• Use the App in compliance with applicable laws.
• Only add/import/store information (including contact details and photos) that you have the right to use.
• Keep your device and exported backup files secure (e.g., by using OS-level device protections).

You are responsible for any content or personal data you choose to store in Orbit and for where you export/share backups.

4. Permissions and device features

Certain features require device permissions, such as:

• Contacts access (read-only) to import/select contacts.
• Notifications to show reminders.
• Photo library access (iOS) to pick a contact photo.

If you deny or revoke permissions, some features may not work.

5. Backups, import/export, and data loss

Orbit may allow you to export your data to a JSON backup file and import it later. You control where backups are stored or shared.

You understand and agree that:

• Backups may contain personal information (e.g., contact names, optional phone numbers, photos, notes, and dates).
• You are responsible for protecting backups and for any third-party service you use to store or share them.
• We do not guarantee that export/import will be error-free on all devices or OS versions.

To the maximum extent permitted by law, we are not liable for loss or corruption of data, including data stored locally or in any backup location you choose.

6. Notifications and reminders (no guarantee)

The App may schedule local notifications for reminders and special dates. Delivery and timing depend on your device, OS settings (Do Not Disturb, battery optimizations), notification permissions, and other factors outside our control.

We do not guarantee that you will receive notifications at a particular time or at all.

7. Premium features and subscriptions

Free vs Premium

Some features may be limited on the free plan (for example, limits on the number of contacts or categories). Premium may unlock higher limits and/or additional functionality. The current features and pricing are shown in the App at the time of purchase.

Purchases and billing

Subscriptions and in-app purchases are processed by the Apple App Store or Google Play (the "Store"). Payment terms, renewals, cancellations, and refunds are governed by the Store's rules and your Store account settings.

Auto-renewal and cancellation

If you purchase an auto-renewing subscription, it will renew unless you cancel it through your Store account settings before the renewal date.

Restore purchases

The App may offer a "Restore Purchases" feature so you can restore eligible purchases on a device linked to your Store account, subject to Store rules and availability.

Subscription management provider (Adapty)

Orbit uses Adapty to manage paywalls and subscription entitlement status. Adapty may be involved in displaying offers and confirming premium access. Purchases are still completed via the Store.

8. Intellectual property

The App (including its design, text, graphics, logos, and code) is owned by us or our licensors and is protected by intellectual property laws.

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

9. Prohibited use

You agree not to:

• Use the App for unlawful purposes.
• Reverse engineer, decompile, or attempt to extract the source code of the App except where permitted by law.
• Interfere with the App's security or attempt to bypass usage limits or paywalls.

10. Third-party services and links

The App may open external links (e.g., our website pages) or launch your email client to contact support. Your use of third-party services is governed by their terms and privacy policies, and we are not responsible for third-party services.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ORBIT IS NOT A MEDICAL, EMERGENCY, OR SAFETY SERVICE. DO NOT RELY ON THE APP FOR EMERGENCY COMMUNICATIONS OR TIME-CRITICAL REMINDERS.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP.

IN ANY EVENT, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

13. Changes to the App or Terms

We may update the App and may change these Terms from time to time. We will update the "Effective date" above when we do. Continued use of the App after changes means you accept the updated Terms.

14. Termination

You may stop using the App at any time. We may suspend or terminate access to the App if required by law or if you violate these Terms.

15. Privacy

Your use of the App is also governed by our Privacy Policy.
